AUTHORIZATION & TESTIMONY SUBMISSION AGREEMENT (EN)#

(For the digital memorial honoring Melissa Foelsch Wells)

This Authorization & Testimony Submission Agreement (“Agreement”) governs the submission of testimonials, stories, photographs, documents, audiovisual materials, or any other contributed content (“Submission”) to the digital memorial dedicated to honoring the life and legacy of Melissa Foelsch Wells (“the Memorial”). By submitting any material to the Memorial, the contributor (You”) acknowledges, agrees, and declares the following:

  1. Purpose of Authorization

You understand and agree that your Submission will be used exclusively for historical, cultural, educational, documentary, and memorial purposes in connection with the preservation of the life story, humanitarian work, diplomatic service, and global impact of Melissa Foelsch Wells. The Memorial is strictly non-commercial and does not authorize or engage in commercial exploitation of any submitted materials.

  1. Grant of Rights (License)

By submitting content, You hereby grant to the Memorial, its curators, administrators, and the heirs of Melissa Foelsch Wells (“the Estate”), a non-exclusive, irrevocable (except as permitted in Section 8), perpetual, royalty-free, transferable, worldwide license to:

  • use, reproduce, display, publish, archive, and preserve your Submission;
  • include your Submission within exhibitions, historical archives, and biographical collections;
  • make editorial decisions necessary for clarity, formatting, and preservation;
  • store your Submission on servers located in Brazil;
  • translate your Submission if required for archival or educational purposes.

This license is limited to non-commercial, respectful, dignified, and memorial uses.

  1. Warranties and Representations

You represent and warrant that:

  1. You are the sole author and rights holder of the submitted material, or
  2. You have obtained full authorization from the rights holder, and
  3. Your Submission does not violate the rights of any third party, including:
  • copyright,
  • image rights,
  • privacy rights,
  • posthumous personality rights,
  • contractual duties,
  • confidential or classified obligations.

You further affirm that:

  • the Submission does not originate from restricted diplomatic, governmental, or UN archives;
  • the Submission does not contain confidential, classified, or security-sensitive information.
  1. Prohibited Content

You agree not to submit any content that is:

  • defamatory, insulting, hostile, harassing, or discriminatory;
  • sexually explicit, violent, or degrading;
  • politically motivated or intended to influence contemporary political debates;
  • misleading, intentionally false, or manipulated (including deepfakes, altered images, or synthetic content);
  • offensive to the dignity, memory, or legacy of Melissa Foelsch Wells;
  • offensive to individuals photographed in historical contexts;
  • in violation of ethical norms applicable to humanitarian and diplomatic environments.

Any Submission violating these prohibitions will be immediately rejected or removed.

  1. No Official Affiliation or Representation

You acknowledge that your Submission:

  • does not establish any affiliation between You and the United Nations, the U.S. Government, or any diplomatic or governmental entity;
  • cannot be used to assert or imply endorsement by any public institution;
  • will be displayed solely as part of a private, family-curated memorial.
  1. Preservation of Historical Integrity

You agree that the Memorial may publish your Submission in a manner consistent with established practices of museums, archives, and cultural institutions, ensuring:

  • contextual accuracy;
  • respect for historical truth;
  • preservation of the diplomat’s legacy;
  • protection of vulnerable individuals represented in the archival materials.

Minor editorial adjustments may be made for clarity, sensitivity, or accessibility without altering the meaning of your Submission.

  1. Protection of the Estate and Posthumous Rights

You expressly acknowledge that the Estate of Melissa Foelsch Wells holds all posthumous personality rights relating to:

  • her name,
  • likeness,
  • voice,
  • image,
  • biographical narrative,
  • personal legacy.

No Submission may be used to misrepresent, distort, or exploit her image, identity, or memory.

Unauthorized commercial use, including films, books, documentaries, merchandising, or advertising, is strictly prohibited without prior written authorization from the Estate.

  1. Right to Request Removal

You may request the removal of your own Submission at any time by contacting the Memorial through the designated email address.

The Memorial reserves the right to:

  • remove content upon request,
  • decline to remove content necessary for historical integrity,
  • maintain a sanitized or anonymized version if required under data protection or archival preservation rules.

Requests involving safety, dignity, or legal violations will be handled with priority.

  1. Legal Enforcement and Remedies

Any violation of this Agreement may result in:

  • refusal or removal of the Submission,
  • permanent ban from contributing to the Memorial,
  • notification to affected individuals or institutions,
  • civil or criminal legal action when applicable.

The Memorial, its curators, and the Estate reserve all legal rights and remedies available under applicable laws, including intellectual property, posthumous rights, privacy and image rights, cultural heritage laws, and international ethical rules.

  1. Governing Law

This Agreement is governed exclusively by the laws of Brazil, including the Brazilian Civil Code, the LGPD (Lei Geral de Proteção de Dados), and all applicable norms relating to image rights, copyright, and posthumous personality rights. Any disputes arising from or related to this Agreement shall be resolved in the courts of the State of São Paulo, Brazil.

Melissa Foelsch Wells

Melissa Foelsch Wells was a distinguished American diplomat whose career spanned over four decades, with postings in countries including Trinidad & Tobago, France, the United Kingdom, Brazil, Guinea-Bissau, Cape Verde, Mozambique, Zaire, and Estonia, as well as key roles in the United Nations focusing on development, emergency relief, and disability prevention.

Born in Tallinn, Estonia, in 1932, she emigrated to the United States as a child and later earned a B.S. cum laude in Foreign Service from Georgetown University.

Fluent in six languages, Wells excelled in international diplomacy and global cooperation, was married to former diplomat Alfred Washburn Wells, and had two sons and three grandchildren.

After retiring, she lived in Spain and the United States, leaving a lasting legacy of dedication to public service and fostering international relations.
